The consumer has the right to notify Atelier À Table that he renounces the purchase, without payment of any penalty and without giving any reason, within 14 days from the day following the delivery of the product.
Article 1: General terms
These Terms and Conditions ("Conditions") apply to all items in the Atelier À Table range and any purchase placed by the client with Atelier À Table.
The client accepts that these Conditions, will be the only ones applicable, to the exclusion of their own general or specific (purchase) conditions, even if they would stipulate that they are the only ones applicable.
Article 2: Price
All prices quoted are always exclusive of VAT and all other taxes to be borne by the customer. If transport, reservation or administrative costs are charged, this will be stated separately.
The stated price refers exclusively to the articles as described verbatim. The accompanying photo is for decorative purposes only and may contain elements of articles not included in the price.
Article 3: Offer
Each offer is only open to customers residing in the European Union. The items are intended solely for normal private use.
Despite the fact that the catalog and website are compiled with the utmost care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date.
If you have specific questions about, for example, sizes, color, availability, delivery time, or delivery method, we kindly request you to contact our customer service in advance (see Article 12).
Atelier À Table is committed to the accuracy, timeliness, or completeness of the information provided only to a best-effort commitment. Atelier À Table is in no event liable for material errors, typographical or printing errors.
The offer is valid as long as stocks last and can be adjusted or withdrawn by Atelier À Table at any time.
Atelier À Table is entitled to - without stating reasons - refuse orders, adjust delivery times, split deliveries, or attach other conditions to the delivery.
Article 4: Reservation of ownership
The delivered items remain the exclusive property of Atelier À Table until full payment has been received from the customer.
However, the risk of loss or damage transfers to the customer upon delivery. The customer commits to informing third parties of Atelier À Table's reservation of ownership if necessary, for example, to anyone intending to seize the items that have not yet been fully paid for.
Article 5: Sanctions for non-payment
Without prejudice to the exercise of other rights available to Atelier À Table, in case of non-payment or late payment from the date of default, the customer is automatically and without notice due an interest of 10% per annum on the unpaid amount. Moreover, the customer is automatically and without notice due a flat-rate compensation of 10% on the amount concerned, with a minimum of 25 euros per invoice.
Article 6: Complaints
Any visible damage and/or qualitative deficiency of an item or other deficiency in the delivery must be reported immediately, under penalty of forfeiture of any right.
Article 7: Garantie
The delivered goods are guaranteed against manufacturing defects for a period of 3 months. The warranty includes the free replacement or repair of the defects.
General
To claim the warranty, the customer must be able to present the proof of purchase.
Any defect must be reported within a period of 2 months after its discovery by the consumer. After this period, any right to repair or replacement expires.
The (commercial and/or legal) warranty does not apply to defects arising from accidents, negligence, falls, abnormal or incorrect use, use of the item for a purpose other than that for which it was designed, non-compliance with the instructions for use or manual, modifications or alterations to the item, rough handling, poor maintenance, abnormal or incorrect use.
It also does not apply to items with a shorter lifespan or wear items.
Defects that manifest after a period of 6 months following the date of purchase, where applicable delivery, are deemed not to be hidden defects, unless proven otherwise by the Customer.
The warranty is non-transferable.
Article 8: Right of withdrawal
The provisions of this article apply only to customers who, in their capacity as consumers, purchase items online:
The consumer has the right to inform Atelier À Table that they are waiving the purchase, without paying a penalty and without giving any reason, within 14 days from the day following the delivery of the product.
Customers wishing to exercise their right of withdrawal must contact Atelier À Table customer service within 14 days from the delivery and return the goods at their own expense to Atelier À Table, Bornstraat 69, 3806 Velm, within 20 days from the delivery of the goods.
Goods with a sale price of 100 Euros or more must be returned to us by courier (DHL, FedEx, etc.).
Only items that are in the original and undamaged packaging, together with all accessories, user manuals, and invoice or proof of purchase, can be returned.
The following items will not be accepted for return under any circumstances:
- used, soiled, damaged, or incomplete items
- items of which the packaging (or part thereof) has been opened
- items that are made to the customer's specifications
- items that cannot be returned due to their nature.
Article 9: Privacy
Atelier À Table commits to using your data exclusively for the execution of the concluded agreement which you finalize through your order and to send you non-committal information from Atelier À Table. If you also wish to receive information via email, please provide your email address.
We treat your data as confidential information and will never pass on, rent, or sell it to third parties. You can request, correct, modify, or delete your data stored in our customer list at any time, and you can refuse Atelier À Table's use of your data to send you information. You can simply request this in writing at the following address: Bornstraat 69, 3806 Velm.
The personal data you provide through this website are processed by Atelier À Table, Bornstraat 69, 3806 Velm. They are processed in accordance with the provisions of the European General Data Protection Regulation (GDPR) of May 24, 2016. Atelier À Table processes personal data only for the purpose for which it was collected and only as long as necessary for this purpose.
The Atelier À Table website uses cookies. Cookies consist of a standard internet technology that allows certain information to be stored and accessed on the user's system. Cookies cannot be used to identify individuals, a cookie can only identify a machine. Every internet user can set their computer in such a way that cookies are not accepted. If your computer does not accept cookies, you may encounter problems during the ordering process. If this is the case, we ask you to contact us so that we can still process your order.

Article 10: Impairment of validity - non-waiver
If any provision of these Terms is declared invalid, unlawful, or void, this will in no way affect the validity, legality, and applicability of the other provisions.
The failure at any time by Atelier À Table to enforce any of the rights listed in these Terms, or to exercise any such right, will never be considered a waiver of such provision and will never affect the validity of these rights.

Article 12: Change of terms
These Terms are supplemented by other terms to which explicit reference is made, and by the general sales conditions of Atelier À Table. In case of contradiction, these Terms shall prevail.
Atelier À Table reserves the right to modify these Terms at any time without further notice. Any purchase made after the modification constitutes acceptance by the customer of these new Terms.
Article 13: Evidence
The customer accepts that electronic communications and backups can serve as evidence.
Artikel 14: Applicable law - Competent court
Belgian law applies, with the exception of the provisions of private international law regarding applicable law and of the Rome-I regulation concerning international sales agreements for movable goods. In case of any disputes, only the courts of Limburg are competent.
